Please read these Terms of Service ("Terms") carefully before using the Misure One website, API integration, retailer embed, or any related service (collectively, the "Service") operated by Misure One Limited ("Misure One," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
By creating an account or otherwise using the Service, you confirm that: (a) you are at least 13 years of age; (b) if you are between 13 and 18, you have obtained verifiable parental or guardian consent; (c) you have the legal authority to enter into a binding agreement; and (d) your use of the Service complies with all applicable laws in your jurisdiction.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent in-product notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain the accuracy of your account information; (c) maintain the confidentiality of your password; and (d) notify us immediately of any unauthorised use of your account at legal@misureone.com.
You are responsible for all activity that occurs under your account. You may not create more than one account per person or use another user's account without their permission.
You agree to use the Service only for lawful purposes. You must not:
We reserve the right to terminate or suspend your account without notice if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.
The Service and its original content, features, design, algorithms, and functionality are the exclusive property of Misure One Limited and its licensors. Our trademarks and trade dress may not be used without our prior written consent.
You retain all ownership rights to the personal data and content you submit to the Service, including your body measurements and fit preferences. By using the Service, you grant Misure One a limited, non-exclusive, royalty-free license to process your data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.
If you provide us with feedback or suggestions regarding the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without compensation or attribution.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
FIT RECOMMENDATIONS PROVIDED BY THE SERVICE ARE BASED ON STATISTICAL MODELS. ACTUAL FIT MAY VARY DUE TO INDIVIDUAL VARIATION, MANUFACTURING TOLERANCES, AND OTHER FACTORS OUTSIDE OUR CONTROL. MISURE ONE DOES NOT GUARANTEE THAT ANY GARMENT PURCHASED BASED ON OUR RECOMMENDATIONS WILL FIT YOU TO YOUR SATISFACTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MISURE ONE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.
IN NO EVENT SHALL MISURE ONE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO MISURE ONE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) NZD $100.
Nothing in this section limits any right you may have under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ) that cannot be excluded or limited by contract.
You agree to defend, indemnify, and hold harmless Misure One and its officers, directors, employees, contractors, agents, licensors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Service in violation of applicable law, or your infringement of any third party's rights.
These Terms shall be governed by and construed in accordance with the laws of New Zealand. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of New Zealand.
For any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt informal resolution by contacting us at legal@misureone.com. If the dispute is not resolved within 60 days of that notice, either party may refer the matter to mediation through the New Zealand disputes resolution framework before pursuing any other legal remedy.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if we believe you have violated these Terms. You may terminate your account at any time by contacting us at legal@misureone.com.
All provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 8, 9, 10, 11, and 12.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Misure One regarding the Service.
Severability: If any provision of these Terms is held to be unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will continue in full force.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
